When you use fungai.art (this website), the Foraging Map, the Herbal Engine, the Extraction Protocols, or any other Fungai Art service, you agree to these terms. If you don't agree, please don't use the services.
We are Robin Fungi and Steph Teÿæ, operating Fungai Art as an independent artistic and herbal practice. The legal entity behind Fungai Art is Fungai Art OÜ, a limited company registered in Estonia (e-Residency framework). All commercial activity — orders, patronage subscriptions, $MYCEL issuance — is conducted by the OÜ. Operational presence in Sweden, Germany, and France. Contact: robin@fungai.art.
Fungai Art is an ecological art project and educational resource. The Herbal Engine, Extraction Protocols, Foraging Map, Health Intelligence, and related materials document traditional plant medicine, modern phytotherapy research, and ecological knowledge.

The Foraging Map shows habitats, traditional harvest locations, and community observations. The map is approximate. Real-world plant identification requires expert knowledge.

Some plants we document have specific legal status that varies by country. Examples include Amanita muscaria, Psilocybe species, Coca leaf, Calamus, Calea zacatechichi, Wild Dagga, Ephedra. We document them for educational purposes only.
You are responsible for knowing and complying with the laws in your country regarding possession, preparation, and use of any plant. Fungai Art does not sell or supply restricted substances and accepts no responsibility for your decisions in relation to them.

The $MYCEL token (known to members as Hyphae) is a utility circulation token deployed on Polygon mainnet by Fungai Art OÜ. Max supply: 88,888,888. Annual mint ceiling: 5% of max.
$MYCEL is not a security, not an investment, and confers no ownership in Fungai Art or rights to future revenue. It is an internal medium of exchange for goods and experiences within the Fungai Art network — comparable to local currencies (Sardex, Bristol Pound) and pre-paid loyalty units.
Hyphae enter circulation through three pathways: Sporing (members earn through contribution), Collaboration (vendors and partners receive Hyphae for services rendered), and Patronage (24-month pre-paid subscription contracts). See /patron for patronage terms.
Hyphae are spent (drawn) on tinctures, ceremonies, academy access, retreats, and special extracts. Drawn Hyphae flow to The Mycelium treasury where they are recycled or composted (burned).
Governance is handled by a separate, soulbound (non-transferable) reputation called mycoTrust. Voice in Mycorrhizal Governance grows from ongoing participation and peer endorsement, not from token holdings. Decisions follow a sociocratic process: composting (discussion) → sporulation (consent vote) → fruiting (implementation).
$MYCEL is not listed on any DEX or CEX. Transfers between members are permitted for gifting only; speculative trading is contrary to the spirit of the token and may result in compost (burn) of listed tokens by the council.
A reference rate (fungai.art/basket) is published monthly indicating an approximate value of 1 MYCEL against a basket of gold (40%), olive oil (30%), and cacao (30%).
The basket is descriptive, not a peg. Hyphae are not redeemable for gold, olive oil, or cacao. Fungai Art OÜ does not hold reserves of these commodities. The basket is a communication tool that gives members a notional sense of the token's weight in everyday terms.
The reference rate has no enforcement mechanism on-chain and confers no claim against Fungai Art OÜ. It is not financial advice. In-network prices for goods are denominated in Hyphae, not EUR — the basket changes how Hyphae are described, not what they buy inside the network.
Patronage subscriptions (Spore €500, Hypha €1,500, Mycelium €5,000+) are pre-paid 24-month consumer contracts between the patron and Fungai Art OÜ. Patrons receive Hyphae at contract start and draw down extracts, ceremonies, and experiences over the term.
At end of term, patrons may: (a) renew, (b) continue at-will drawing remaining Hyphae, or (c) request a refund of any unused balance in EUR, calculated at the basket reference rate on the date of refund request.
Patronage is not investment. Patrons receive goods and experiences of genuine value, not financial returns. No interest accrues. No appreciation guarantee. Standard EU consumer protection applies. Patronage contracts may be cancelled within 14 days of signing with full refund (EU statutory withdrawal period).

We are not liable for any indirect, incidental, or consequential damages arising from your use of the site, the information here, or any purchase from us. Where Swedish or EU consumer law gives you stronger rights, those rights apply (and override this paragraph).
We may update these terms. Material changes will be flagged on the homepage and in the newsletter. Continued use after a change means you accept the new terms.
These terms are governed by the laws of Sweden. Any dispute will be resolved in Swedish courts, except where mandatory EU consumer law applies to you.
